Slip, Trip & Fall Claims

This category is fairly broad but in essence a claim for compensation for personal injury can be made where a fall has occurred which was not you fault and was the result of the area in question, being in a dangerous and hazardous state.

The most common types of accident are:-

1. Trips and slips caused by dangerous and defective roads and pavements.
2. Trips, slips and falls in shops of other public places including licensed premises.
3. Slips caused by dangerously slippery or wet floors in any public place.
4. Slips caused by over-polished floors in any public place.
5. Trips caused by dangerous carpets or defective flooring.
6. Trips caused by obstructed walkways.

The only way to prove that an area is dangerous and therefore a tripping hazard, is by photographic evidence. It is essential that the exact location and the exact defect is identified and it is always a question of fact as to whether or not an area was dangerous or not. The Law applies common sense rules in cases such as this. As with all claims, it is preferable if witnesses are available to give evidence. It is also beneficial to a claims success if the accident was reported to the relevant local authority, shop-keeper or owner of the premises.
