Slip, Trip & Fall ClaimsThis category is fairly broad but in essence a claim
for compensation for personal injury can be made where a fall has occurred
which was not you fault and was the result of the area in question, being
in a dangerous and hazardous state. The only way to prove that an area is dangerous and therefore a tripping hazard, is by photographic evidence. It is essential that the exact location and the exact defect is identified and it is always a question of fact as to whether or not an area was dangerous or not. The Law applies common sense rules in cases such as this. As with all claims, it is preferable if witnesses are available to give evidence. It is also beneficial to a claims success if the accident was reported to the relevant local authority, shop-keeper or owner of the premises.
